Terms of Use — Night Replays

These Terms of Use ("Terms") govern your use of the Night Replays app ("the app"). By downloading or using the app, you agree to these Terms. If you do not agree, please do not use the app.

The service

Night Replays is an independent app that helps you browse, by date, the songs played on Korean late-night radio programs and listen to them through a music service you choose. It is not affiliated with, endorsed by, or sponsored by KBS, MBC, Apple, Spotify, or any other broadcaster or music service. All program names, station names, and trademarks belong to their respective owners.

Third-party content and services

The song lists, broadcast replays, artwork, and audio are produced and owned by the respective broadcasters (KBS, MBC) and music services (Apple Music, Spotify, YouTube Music, Melon, Genie, Bugs, FLO). The app links to and helps you access this publicly available content; it does not own or license it to you. Your use of each music service is also subject to that service's own terms and privacy policy. Availability of any program, date, or track depends on those third parties and may change or disappear without notice.

Subscriptions, free trials, and billing

Some features (in-app DJ-talk Replay, Mix mode, and the Apple Watch remote) require a Premium subscription. Subscriptions are auto-renewing and are sold and billed by Apple through your App Store account:

• Payment is charged to your Apple Account at confirmation of purchase.
• The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period, at the price shown in the app.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
• You can manage or cancel your subscription in your App Store account settings after purchase.

Purchases are also subject to Apple's standard Licensed Application End User License Agreement (EULA), which applies to apps downloaded from the App Store.

Acceptable use

The app is for your personal, non-commercial use. You agree not to misuse the app or attempt to disrupt, reverse-engineer, or interfere with its operation or the third-party services it relies on.

Intellectual property

The app itself — its software, design, and original text — belongs to its developer. Radio broadcasts, songs, and related media accessed through the app remain the property of their respective rights holders. Nothing in these Terms grants you rights to that third-party content beyond what those rights holders permit.

Disclaimer

The app is provided "as is" and "as available," without warranties of any kind. Because the app depends on third-party broadcasters and music services, we do not guarantee that any content, replay, or track will be available, accurate, or uninterrupted.

Limitation of liability

To the maximum extent permitted by law, the developer is not liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the app or any third-party content or service accessed through it.

Changes

We may update the app or these Terms from time to time. The current version is always posted at this URL with its "Last updated" date. Continued use of the app after changes means you accept the updated Terms.
